Agreement Covers
This Agreement governs your use of the Site and the ECG GRAPHICS & PRINTING service (the "Service"). The Service permits customers that have an appropriate relationship either with: (i) institutions of higher learning, fraternal organizations, honor societies and other collegiate groups (collectively, "Institutions"); (ii) corporations and small businesses; (iii) elementary and secondary schools; or (iv) other organizations, to design and purchase custom merchandise properly describing that relationship. You understand that by using the Site and the Service, you have agreed to the terms and conditions of this Agreement and you agree to use the Site and the Service solely as provided in this Agreement.
Intellectual Property Rights of ECG GRAPHICS & PRINTING and Third Parties
ECG GRAPHICS & PRINTING is committed to the appropriate and legal use of the intellectual property of others, and we require our users to behave similarly. Unless otherwise noted, all materials, including images, illustrations, designs, icons, photographs and written and other materials that appear on the ECG GRAPHICS & PRINTING Site (collectively the "Contents") are copyrights, trademarks, trade dress and/or other intellectual properties owned, controlled or licensed by ECG GRAPHICS & PRINTING.

ECG GRAPHICS & PRINTING is the owner of the ECG GRAPHICS & PRINTING; other trademarks made available through this Site, including logos, slogans, color schemes and design trademarks, are licensed for use by ECG GRAPHICS & PRINTING from Institutions and other third parties (the "Licensed Marks"). By using the ECG GRAPHICS & PRINTING Site, you agree to limit your use of Licensed Marks to uses that are directly related to such third parties and to comply with any restrictions or conditions imposed on the use and access of the Licensed Marks by the third parties. ECG GRAPHICS & PRINTING will notify you of such terms if your usage is in violation of such terms. Generally, products created using images available on the site should not be resold commercially. In the event that you wish to resell such products, you agree to contact ECG GRAPHICS & PRINTING and verify the legality of reselling such products prior to doing so. Designs created using the text tools and images available through the site are in no way the exclusive property of the customers who assemble such designs. ECG GRAPHICS & PRINTING retains the right to display such designs or offer them (or variations of such designs) to other customers. Additionally, ECG GRAPHICS & PRINTING has the sole discretion to reject any order that it considers libelous, defamatory, obscene, profane (according to standards established by the FCC), portraying irresponsible use of alcohol or other substances, advocating persecution based on gender, age, race, religion, disability or national origin, containing explicit sexual content or is otherwise inappropriate for ECG GRAPHICS & PRINTING production. You agree to not use ECG GRAPHICS & PRINTING's Service to create any material that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable, or that infringes on any patent, trademark, trade secret, copyright or other proprietary rights of any third party. If any of the users violate the law. Pursuant to Title 17 of the United States Code, Section 512, we have implemented procedures for receiving written notification of claimed copyright infringement and for processing such claims in accordance with such law. If you believe your copyright, trademark, or other intellectual property right is being infringed by a user of ECG GRAPHICS & PRINTING, please provide written notice to the representative for the notice of claims & infringement.
ECG GRAPHICS & PRINTING supports high standards for manufacturing labor conditions. Accordingly, we seek to work with suppliers who promote such standards within their operations. ECG GRAPHICS & PRINTING relies upon referrals, reputation and, in some cases, personal inspections to identify such vendors.
Deposit & Payment Policies
We accept cash, checks, ACH, PayPal, and credit cards (American Express, Discover, Master Card, Visa, and most debit cards). Payment is due upon receipt, though it may be made at any point during the production stages of your order. If you are paying by check, please send immediately upon approving your quote in order to avoid a delay in receiving your order.
If a completed order is not paid for within 30 business days of its completion an additional financing charge will apply. Invoices unpaid after 30 days of project completion will be subject to a 1.5% charge, 3% after 60 days, and an additional 1.5% every 30 days thereafter.
Receiving Order Policy
We encourage you to check the quantities and quality of the garments you receive from us immediately. ECG GRAPHICS & PRINTING Company, LLC (“DSP”) cannot be held accountable for defects or problems with your order unless contacted within 48 hours of delivery.
Rush Order Policy
We understand that there are occasions when orders are needed sooner than 10 business days and we strive to fulfill those orders. If an order is being shipped, then the rush charges apply to our production time only. The amount of time it takes the carrier to get the order to you is not guaranteed by DSP. We cannot guarantee that we can accommodate all rush orders; however, we will do our best as our customer's priority and satisfaction is our number one priority.
Rush orders on screen-printed apparel items are available for a 10% rush charge. Rush orders are generally delivered within one week. Delivery times may vary. Any order requiring faster delivery than a Standard Delivery order may not change or cancel your order.

Pick-up Order Policy
We understand that scheduling time to pick up your order can be difficult, so we offer the option to ship the item(s) to you at an additional shipping cost.

If you still prefer to pick-up your order(s) you have a 3 day pick up window upon receiving notification of the project completion. If after 3 days you fail to schedule a pick up for your project, storage fees of 10% (per day) of the total invoiced amount will be applied. If after 5 business days and your order is still not picked up your project it would be considered abandoned. In which, an additional 30% fee of the total invoice will be applied.

Shipping Policy
Shipping is not included in estimates unless specified. Shipping time is not included in turnaround time. Once the shipment is handed over to the carrier, we cannot guarantee timeliness or exact delivery dates. Domestic UPS Ground shipping times from our facility are from Zip Code 92115.
Split Shipping Policy
We can split your order and ship to multiple locations, billable at current rates. Please let us know about the split shipment before we print and box your order, otherwise additional charges may apply.

Packaging Policy
All items will be bulk packaged. Individual folding, tagging, bagging, etc. shall be charged at the then current rates.

Returns Policy
ECG GRAPHICS & PRINTING goes to great lengths to ensure that all orders are filled accurately and on time and are of the highest quality. Accordingly, ECG GRAPHICS & PRINTING accepts returns and will refund payment if and when customers are disappointed by ECG GRAPHICS & PRINTING merchandise for one of the following reasons: (a) the blank items themselves are materially flawed; (b) the quality of the decorating (i.e., the printing or embroidery) is below a reasonable range of expectations; or (c) the design of the final product is materially different from the final design submitted by the customer.
Cancellation Policy
For Standard Delivery orders, you may change or cancel your order within twenty-four (24) hours of submitting your order. In the event an order needs to be canceled, refunds or return of deposits will be based on the status of the order (Have the items been ordered? Have any of the items been printed? Etc.) and may be subject to penalties and/or restocking charges, at a minimum of 15% of your order.

Refunds Policy
Refunds - and quantity - are reserved to the sole discretion of ECG GRAPHICS & PRINTING.

Limit of ECG GRAPHICS & PRINTING Responsibility Policies
ECG GRAPHICS & PRINTING will be responsible for acting only on those instructions sent to ECG GRAPHICS & PRINTING that actually are received and does not assume responsibility for malfunctions in communications facilities not under its control that may affect the accuracy or timeliness of any orders you send. ECG GRAPHICS & PRINTING is not responsible for any losses or delays in transmission of orders arising out of the use of any Internet Access Service Provider or caused by any browser software or any computer virus or related problem that may be attributable to services provided by any Internet Access Service Provider. ECG GRAPHICS & PRINTING is not responsible should you give incorrect instructions or if your credit-card payment is not processed by your credit-card company. The information and materials contained in this Site, including text, graphics, links or other items, are provided "as is", "as available". ECG GRAPHICS & PRINTING does not warrant the accuracy, adequacy or completeness of the information and materials on the Site and expressly disclaims liability for errors or omissions in this information and materials. No warranty of any kind, implied, express or statutory, including but not limited to the warranties of non-infringement of third party rights, title, merchantability, and fitness for a particular purpose or freedom from computer virus, is given in conjunction with the information and materials. In no event will ECG GRAPHICS & PRINTING be liable for any damages, including without limitation, direct or indirect, special, incidental, or consequential damages, losses or expenses arising in connection with this site or use thereof or inability to use by any party, or in connection with any failure of performance, error, omission, interruption, defect, delay in operation or transmission, computer virus or line or system failure, even if ECG GRAPHICS & PRINTING, or representatives thereof, are advised of the possibility of such damages, losses or expenses.
Customer supplied garments Policy
Customers supplying garments is not recommended. Customers who choose to supply their own garments away must adhere to the following requirements.
1. ECG GRAPHICS & PRINTING is NOT responsible for any damages/ defective garments.
2. Customer must provided 2 extra of each garment size and style. These extras will be used as inventory in the case of spoilage. If 2 extra garments are unable to be supplied, the customer will be responsible for the cost of any spoilage replacements up to 2 per style and color. If customer is unwilling to pay for the replacements the customer will be forfeiting the number of garments spoiled from the invoiced total amount.
3. Prior to or upon delivering the garments for print to ECG GRAPHICS & PRINTING customer must provide ECG GRAPHIC & PRINTING with the source and item number of all garments types. PLEASE NOTE: any garment missing a label that specifies the garment's origin and material make up will not be accepted for printing.
4. Customer will be charged an additional handling fee for the counting and inspection of the garments by an ECG GRAPHICS & PRINTING team member. If defects are discovered, customer must supply replacement garments before the order is moved into production.
5. If spoiled garments are unable to be replace due to availability ECG GRAPHICS & PRINTING will replace the garment with a similar garment of blend and color. (Blend and color don't have to be an exact match) If customer does not approve of the replacement garment the customer may select a garment of lesser or equal value. Spoilage replacement my effect production completion and delivery date.

Artwork Policy
All artwork produced by ECG GRAPHICS & PRINTING is owned by ECG GRAPHICS & PRINTING, unless purchased outright by the client. The purchasing of the artwork must be discussed prior to releasing full rights of said artwork.
By submitting artwork to us, you warrant that it is not copyrighted by any third party and that you are permitted to submit it to us for printing. In the event the artwork is copyrighted or you are not permitted to submit it to us, you agree to indemnify and hold ECG GRAPHICS & PRINTING along with its officers, employees, and members harmless for all liability, damages, and attorney fees that may be incurred in any legal action connected with copyright infringement or the unauthorized use of the artwork provided and approved by you.

Turnaround Time Policy
Typical turnaround time is 10 business days (two to three full-weeks) from the time that art mockups are approved with a signature or via email. Some services like relabeled will add to our typical turnaround. Rush charges may apply for orders needed sooner than our typical turnaround. Turn time on larger orders (1,500 pieces or more than 5 designs) may require longer time to produce. Please inquire about our current turn time on larger orders.
Overruns & Underruns Policies
Overruns or Underruns should not exceed 10% on quantities ordered shall constitute acceptable delivery. ECG GRAPHICS & PRINTINGwill bill for actual quantity printed and delivered. In other words, we may print too many shirts (extremely rare) or we may botch a few and deliver a few less than ordered. This is the nature of the printing industry. If you REQUIRE exact quantities, then please have a conversation with us about it. We’ll likely need to charge an “exact quantity fee” in order to insure this, meaning that we’d order more than we need in case there is a misprint. We will return the unprinted garment and pay the restocking fee.

Proofs & Samples Policies
ECG GRAPHICS & PRINTING stands behind the quality of our screen printing. We will reproduce your graphic onto the garment or substrate with maximum accuracy, quality, and consistency. The satisfaction of the end user with the final printed product is subjective. We offer detailed mock ups (approval by the client is mandatory for every order) pre-production samples cost $50 per color printed or each screen set up as per location and are subject to standard turn time. We can send blank samples of any garment, along with previously printed samples, for far less than a printed sample. We do not offer in-house press checks. If you order a sample and decide to order from us, the sample fee will be credited to your final order total.
Color fidelity on split/ Leaked print color Policies
Because of the split print process; you may notice some minor color variations between the split locations. Our heat curing system can affect the dischargeability of a fabric, which can affect the appearance of the color of the second print even when we use the exact same ink throughout the process. While we can’t guarantee an exact match for both locations every time, we will absolutely try our best and hold ourselves to the same high quality standards we usually do.
Mistakes & Misprints Policies
In the event that we make a terrible error in printing your shirts, then we will reprint the order for you at no additional cost. We do not offer refunds. This rarely happens and really only applies to serious mistakes like printing the wrong art, printing the wrong location, or ordering the wrong color garments. If you require precise measurements of artwork, pantone ink matching, or press checks, this must be communicated prior to approval and it is your responsibility to make sure these requests are notated in the “notes” section of the quote sent for approval, and a surcharge may apply. In this (and any printing industry), misprints happen. A screen could come out of registration, we may find a defect in the garment, the garment may come from a bad dye lot, etc. There are a million things that could go wrong but we manage to keep misprints and defects well below 1% of all garments printed over the course of a year. This isn’t to say that your order will be guaranteed to have less than 1% misprints, this just happens to be our average. If we misprint a few of your garments then we will NOT charge you for these, and we’ll likely even throw them in with the order at no charge if they are passable. Since misprints can happen, we’d encourage you to order extra garments if you need exact quantities due to pre orders or team member requests. For example, if you are ordering a single Extra Small garment for your kid, there is a chance that this garment becomes a misprint. Due to the nature of the screen printing process, we would be unable to set up the screens again just to print this single shirt.
We try to minimize it, but misprints do happen and we cannot predict when. Work with us and plan ahead.

Misprint Allowance (For Contract Printing)
When printing on customer supplied garments, we require a 5% misprint allowance or a minimum of 1 shirt per design per garment color, whichever is greater, with no penalty to us. Percentages are based on quantity of imprints, not quantity of garments. We strongly recommend that you order extra garments in each size, style and/or color in the event of misprints. Exact Quantities are not guaranteed and are not available on Rush Orders. DSP will not be held responsible for consequential damages such as profit loss on spoiled goods.

Manufacturer Defects Policy
ECG GRAPHICS & PRINTING is not responsible for mistakes or defects on behalf of the manufacturer or distributor: mislabeled sizes, inconsistent coloring, dye lots, manufacturer garment defects, etc. All garments will be counted in bulk (dozens, or however they are packaged by the manufacturer). We cannot inspect each garment or count them individually. Manufacturer and distributor defects or misshapes will delay production until all garments are received. It is highly recommended to order more garments than needed for each size. All additional garments will be included in the print run and we will bill for what is printed.

Deadlines Policy
All orders with a specific deadline must receive written confirmation from ECG Graphic & Printed staff. Requesting a deadline does not make it effective, as scheduling often needs to be confirmed with our production manager.

Drop Dead Dates Policy
We define a drop-dead date as the day that the order needs to be completed and ready for shipping (as opposed to an “in-hands-date”, the date when the client needs the order in their hands). We will not commit to a drop dead date until we’ve received order confirmation from the client. It is the client’s responsibility to inform us of their garment selection, quantities and deposit payment. We also need to know the desired completion date upon confirmation, at which time we will apply the drop-dead-date to the job.

Set up Cost Policy
Set up cost are charges that are applied to a quote/ invoice to cover the labor that takes to process the artwork and other supplies for the printing process. All files, resources, and/ or supplies used and produced during this process are owned by ECG GRAPHICS & PRINTING.
Out of Stocks Policy
It is unfortunate, but sometimes our vendors will run out of particular styles or colors. If this happens we can offer a variety of possible substitute products from other vendors, or you can choose to wait until the items are back in stock. If you choose to wait for the inventory to be replenished then we cannot guarantee the turnaround time or that the items will be back in stock when the vendor says they will. If you choose a substitute garment then we should be able to stick to our typical turnaround time unless those garments are out-of-stock as well.
Garment Selection & Subjectivity Policies
For custom orders we purchase and supply the garments. We expect our customers to do the research on garments before placing an order with us. If garment selection is sensitive, we strongly encourage ordering samples of the garments before placing an order. We also required contract screen printing clients to provide us with a detailed list of garments including manufacturer, style number, color, size, and quantities of each to be printed prior to order confirmation. We may be unable or refuse to print on certain garments based on garment content. Unless stated otherwise on the respective services page, our minimum order is 24 pieces for contract printing.
Digital renditions and mockups of the shirt may vary from physical. Therefore, we highly suggest the customer sees the final color of the garment if the sensitivity of the color is high. When the final order is received, we cannot guarantee that the customer will like the garments they chose. We do guarantee print quality at all times. We also will open our showroom to show customers samples of what we have in the showroom to aid the decision, but we cannot guarantee that every garment is in the showroom. Subjectivity or whether or not the customer likes the garment they chose is the responsibility of the customer and not DSP. The customer is responsible for knowing the terms of the company whose garments they chose to purchase. For the end user review. We operate under very specific and numerous quality controls, standard operating procedures, and guidelines to ensure a quality finished product, we will not be held responsible for end user subjectivity.

We will always choose what we think is the best print method for your job unless you specify otherwise
